{"id":3078,"date":"2021-12-01T20:09:58","date_gmt":"2021-12-01T19:09:58","guid":{"rendered":"https:\/\/ncrlawyers.com\/novi-nacrt-zakona-iz-oblasi-radnog-prava\/"},"modified":"2026-06-04T14:19:26","modified_gmt":"2026-06-04T12:19:26","slug":"novi-nacrt-zakona-iz-oblasi-radnog-prava","status":"publish","type":"post","link":"https:\/\/ncrlawyers.com\/sr\/novi-nacrt-zakona-iz-oblasi-radnog-prava\/","title":{"rendered":"Novi Nacrt zakona iz oblasi radnog prava"},"content":{"rendered":"\n<p class=\"has-normal-font-size wp-block-paragraph\">Iako je tek pro\u0161ao javnu raspravu i jo\u0161 uvek nije formiran finalni tekst, Nacrta zakona o radnom anga\u017eovanju zbog pove\u0107anog obima posla u odre\u0111enim delatnostima (u daljem tekstu: <strong>Nacrt zakona<\/strong>) privukao je veliku pa\u017enju.<\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Prema procenama u Srbiji je neformalno zaposlenih vi\u0161e od pola miliona ljudi, a osim u poljoprivedi, radnika na sivo je najvi\u0161e u turizmu i ugostiteljstvu i gra\u0111evinarstvu. Predlaga\u010d zakona Ministarstvo za rad i zapo\u0161ljavanje, bora\u010dka i socijalna prava (u daljem tekstu: <strong>Minisarstvo<\/strong>) navodi da je glavni cilj suzbijanje sive ekonomije na na\u010din na koji je to u\u010dinjeno Zakonom o sezonskim radnicima. Naime, Ministarstvo posebno isti\u010de rezultate koji su postigli ovim zakonom. Pre po\u010detka njegove primene, izme\u0111u 60 i 80 hiljada sezonaca u poljoprivredi radilo je na crno, dok danas oko 53 hiljade radnika tokom godine bude prijavljeno putem uspostavljenog sistema. Ne samo da je na ovaj na\u010din regulisan radnopravni re\u017eim sezonski radnika, ve\u0107 je na ovaj na\u010din dr\u017eava ostvarila dodatni prihod koji prema procenama iznosi oko pet miliona evra.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-ast-global-color-0-color has-text-color\" style=\"font-size:19px\">Neka od re\u0161enja koja predvi\u0111a Nacrt zakona<\/h2>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Samim tim, na krilima navedenog uspeha, Ministarstvo je predlo\u017eilo ovaj Nacrt zakona koji bi se pored poljoprivrede primenjivao i u oblasti ugostiteljstva, gra\u0111evinarstva, turizma, poslova koji se odnose na pomo\u0107 u ku\u0107i i odr\u017eavanje stambenih zgrada.<\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Jasno je da se Nacrt zakona fokusira na one oblasti u kojima postoji nedostatak radne snage na tr\u017ei\u0161tu rada, a kako bi se poslodavcima omogu\u0107ilo da na \u0161to lak\u0161i na\u010din prona\u0111u kvalifikovanu radnu snagu. <\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Anga\u017eovanje lica po osnovu re\u0161enja iz Nacrta zakona podrazumeva anga\u017eman van radnog odnosa, uz ograni\u010deno vremensko trajanje. Naime, radno anga\u017eovanje lica ne mo\u017ee da traje du\u017ee od 15 dana tokom jednog kalendarskog meseca, osim na poslovima poljoprivrede, pomo\u0107i u ku\u0107i i \u010di\u0161\u0107enja stambenih zgrada.<\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Pored toga, ograni\u010davaju\u0107i faktor je da Poslodavac ne mo\u017ee da radno anga\u017euje lice u skladu sa ovim Nacrtom, ukoliko je u prethodna tri meseca otkazao ugovor o radu zaposlenima na istim poslovima, po osnovu vi\u0161ka zaposlenih u skladu sa zakonom kojim se ure\u0111uje rad.<\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">S druge strane, ono \u0161to svakako treba da olak\u0161a rad poslodavcima je re\u0161enje prema kome stranac kome u skladu sa va\u017ee\u0107im viznim re\u017eimom za ulazak u Republiku Srbiju nije potrebna viza, mo\u017ee biti radno anga\u017eovan na ovim poslovima, bez obaveze pribavljanja dozvole za rad, za vreme dok boravi u Republici Srbiji.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-ast-global-color-0-color has-text-color\" style=\"font-size:19px\">S druge strane,..<\/h2>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Me\u0111utim, nisu svi pozitivno reagovali na predmetni Nacrt zakona.<\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Naime sindikati i pojedini stru\u010dnjaci za radno pravo smatraju da novi propis obespravljuje radnike, onemogu\u0107ava im zakonsku za\u0161titu i na mala vrata dozvoljava zapo\u0161ljavanje stranaca, bez ugovora o radu. Usvajanjem predmetnog Nacrta bi se, prema njihovom mi\u0161ljenju, glavne grane industrije svele na rad van radnog odnosa. Posebno isti\u010du da prema ovom Nacrtu zakona, radnici nemaju pravo na ograni\u010deno radno vreme i prekovremeni rad, pla\u0107eno odsustvo kao ni pravo na regres i otpremninu. <\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Pored navedenog sindikati posebno isti\u010du da navedeni Nacrt zakona \u0161titi poslodavce od sudskih postupaka za radnu eksploataciju, nezakonit prestanka radnog odnosa kao i druge radne sporove \u010dime se uvodi dodatna pravna nesigurnost za sve radnike. Posebno se isti\u010de da je poslednjih godina primetna pojava da privremeno anga\u017eovanje stranih radnika, dovodi do stvaranja novih oblika radne eksploatacije.<\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Samim tim zaposleni ne mo\u017ee da se obrati sudu i pokrene radni spor ili da tu\u017ei za nezakonit otkaz. <\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Tako\u0111e, oni ukazuju na mogu\u0107nost zloupotrebe Nacrta zakona s obzirom na nemogu\u0107nost celovite i efikasne kontrole njegove primene. Naime, prema navodima sindikata danas jedan inspektor proverava nekoliko hiljada firmi i te\u0161ko da \u0107e oni mo\u0107i da kontroli\u0161u da li zaposleni rade dozvoljenih 15 dana koliko zakon dozvoljava ili ceo mesec. <\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Dodatno, sindikati smatraju da se stvara nelojalna konkurencije prema doma\u0107im radnicima na taj na\u010din \u0161to se Nacrtom zakona dozvoljava povremeno anga\u017eovanje stranaca kojima nije potrebna viza za ulazak u Srbiju i na taj na\u010din ignori\u0161u odredbe Zakona o zapo\u0161ljavanju stranaca.<\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">S druge stane, Poslodavci zakon brane \u010dinjenicom da se on odnosi samo na povremeno anga\u017eovanje radnika, a ne na zapo\u0161ljavanje. Oni posebno isti\u010du da je prednost ovog sistema to \u0161to korisnici socijalne pomo\u0107i, naknade za nezaposlene kao i penzioneri ne gube prava na ova primanja ukoliko su anga\u017eovana na ovaj na\u010din \u0161to je upravo i bio jedan od razloga za\u0161to puno sezonskih radnika \u017eeli da radi neprijavljeno<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-ast-global-color-0-color has-text-color\" style=\"font-size:19px\">Jo\u0161 uvek ima vremena za pobolj\u0161anja<\/h2>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">U\u010desnici javne debate predlo\u017eili su neke izmene koje pre svega imaju za cilj dodatno ograni\u010denje mogu\u0107nosti zloupotrebe prava poslodavca prilikom anga\u017eovanja lica u slu\u010daju pove\u0107anog obima posla. U tom pogledu je i predlog da se propi\u0161e obaveza poslodavca da \u201eradniku na dan\u201c naredne godine ponudi ugovor o radu, ukoliko za to postoji otvorena pozicija na tom poslovima kao i da se zaposlenom ne mo\u017ee otkazati ugovor o radu i prebaciti na sistem dnevne prijave u odre\u0111enom vremenskom periodu.<\/p>\n\n\n\n<p class=\"has-normal-font-size wp-block-paragraph\">Javna rasprava je zavr\u0161ena, tako se o\u010dekuje da predlaga\u010d uzme u obzir sve primedbe i finalizuje Nacrt zakona pre nego \u0161to potom bude podnet u skup\u0161tinsku proceduru na
