Razlog tome le\u017ei u \u010dinjenici da nadle\u017eno Ministarstvo za ljudska i manjinska prava jo\u0161 uvek nije donelo podzakonska akta koja bi detaljnije regulisala obaveze privrednih dru\u0161tava uvedene ovim Zakonom.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Ipak, Zakon eksplicitno predvi\u0111a obaveze za privredna dru\u0161tva sa vi\u0161e od 50 zaposlenih i radno anga\u017eovanih lica, koja se ogleda u sprovo\u0111enju godi\u0161njih planova i programa rada, koji, pored elemenata propisanih zakonom, obavezno sadr\u017ee i deo koji se odnosi na ostvarivanje i unapre\u0111enje rodne ravnopravnosti. Dakle, intencija zakonodavca jeste da obave\u017ee poslodavce da u svom poslovanju donesu mere koje bi uticale na unapre\u0111enje rodne ravnopravnosti, a u okviru spomenutog plana ili programa uvrste i ocenu stanja u vezi sa polo\u017eajem \u017eena i mu\u0161karaca kod poslodavca.  <\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kako Zakon predvi\u0111a, uravnote\u017eena zastupljenost polova postoji kada je zastupljenost jednog od polova izme\u0111u 40-50% u odnosu na drugi pol, a osetno neuravnote\u017eena zastupljenost polova postoji kada je zastupljenost jednog pola ni\u017ea od 40% u odnosu na drugi pol.  <\/p>\n\n\n\n<p class=\"has-text-align-justify\">Poslodavci su du\u017eni da obaveste i nadle\u017eno Ministarstvo za ljudska i manjinska prava o dono\u0161enju plana ili programa u roku od 15 dana od dana dono\u0161enja, kao i da uz obave\u0161tenje dostave izvod koji se odnosi na ostvarivanje i unapre\u0111enje rodne ravnopravnosti. Dodatno, privredna dru\u0161tva su u obavezi i da Ministarstvu dostavljaju izve\u0161taj o realizaciji godi\u0161njeg plana ili programa.  <\/p>\n\n\n\n<p class=\"has-text-align-justify\">Iako Zakon ostavlja prostora za mnoge nedoumice, zakonodavac je predvideo nov\u010danu kaznu za privredna dru\u0161tva u rasponu od 50.000,00 dinara do 2.000.000,00 dinara, u slu\u010daju ne postupanja po obavezama predvi\u0111enim Zakonom. Jedan od razloga koji zakonodavac prepoznaje kao validan razlog za ka\u017enjavanje poslodavaca jeste i ukoliko poslodavac ne obezbedi zaposlenom i radno anga\u017eovanom licu, bez obzira na pol, odnosno rod i porodi\u010dni status, jednake mogu\u0107nosti za dodatno usavr\u0161avanje i dodatno obrazovanje.  <\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u010cinjenica je da je zakonodavac prepoznao probleme u praksi i poku\u0161ao da iste uokviri i reguli\u0161e putem novog Zakona. Me\u0111utim, o\u010dekuje se da nadle\u017eno Ministarstvo donese detaljnije smernice koje \u0107e olak\u0161ati primenu ovog Zakona u praksi. Ipak, i u nedostatku istih, Zakon je na snazi i predvi\u0111a obaveze za poslodavce sa preko 50 zaposlenih i radno anga\u017eovanih lica, pa je ovo prilika za poslodavce da usklade svoje poslovanje sa novim Zakonom i donesu obavezne interne akte. Jasna je tendencija zakonodavca da u set internih akata koje je poslodavac obavezan da ima shodno Zakonu o radu, Zakonu o bezbednosti i zdravlju na radu, Zakonu o arhivskoj gra\u0111i, uvrsti i akta po Zakonu o rodnoj ravnopravnosti i na taj na\u010din prida na zna\u010daju ovoj temi, koja je nesumnjivo veoma aktuelna u praksi. <\/p>\n\n\n\n<p class=\"has-text-align-justify\"><em>Ovaj \u010dlanak je isklju\u010divo informativne prirode i ne predstavlja pravni savet.
