Koliki je zna\u010daj pravilnog upravljanja radnim odnosima govori i \u010dinjenica sve ve\u0107eg broja radnih sporova koje zaposleni pokre\u0107u protiv poslodavaca. Nakon \u0161to se javila potreba da tvoja firma zaposli dodatan broj ljudi na odre\u0111enim pozicijama, te nakon \u0161to si objavio oglas da zapo\u0161ljava\u0161, slede\u0107i korak je organizovanje intervjua sa kandidatima radi upoznavanja i procene da li kandidati ispunjavaju kriterijume koji su potrebni za otvoreno radno mesto. Vodi ra\u010duna da se Pravilnikom o organizaciji i sistematizaciji radnog mesta propisuju kriterijumi za svako radno mesto, pa bi na osnovu prijave kandidata kao i na osnovu intervjua, trebalo da proveri\u0161 da li tvoj potencijalno budu\u0107i zaposleni ispunjava sve kriterijume. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">Nakon \u0161to si sa potencijalnim kandidatom dogovorio uslove saradnje, slede\u0107i korak jeste zaklju\u010denje ugovora o radu. Ugovor o radu se obavezno zaklju\u010duje u pisanoj formi i potpisuju ga poslodavac i zaposleni. U samom ugovoru o radu se navodi datum stupanja na rad zaposlenog, i od tog datuma zaposleni po\u010dinje da ostvaruje sva prava i obaveze iz radnog odnosa. Imaj u vidu da si du\u017ean da zaposlenog, pre stupanja na rad, pisanim putem obavesti\u0161 o <a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon_o_sprecavanju_zlostavljanja_na_radu.html\">zabrani vr\u0161enja zlostavljanja na radu<\/a> i pravima, obavezama i odgovornostima zaposlenog i poslodavca u vezi sa zabranom zlostavljanja.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Ugovor o radu koji zaklju\u010duje\u0161 sa zaposlenim se mo\u017ee zaklju\u010diti na neodre\u0111eno vreme ili na odre\u0111eno vreme, uz navo\u0111enje osnova za zaklju\u010denje ugovora o radu na odre\u0111eno vreme (navo\u0111enje objektivnih razloga zbog kojih se ugovor o radu zaklju\u010duje na odre\u0111eno vreme). U ugovoru o radu je obavezno nazna\u010diti da li se radni odnos zasniva na odre\u0111eno ili neodre\u0111eno vreme. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">Pored navedenog, Zakon o radu propisuje obavezne elemente ugovora o radu koje je nu\u017eno da isti sadr\u017ei, kako bi se na \u0161to jasniji i precizniji na\u010din definisao radni odnos. Ukoliko je tvoj novi zaposleni osoba bez radnog iskustva mo\u017eete dogovoriti i ugovaranje probnog rada. Probni rad je period tokom kog bi zaposleni trebalo da poka\u017ee odgovaraju\u0107e radne i stru\u010dne sposobnosti, u suprotnom radni odnos prestaje danom isteka probnog rada. Probni rad mo\u017ee trajati najdu\u017ee \u0161est meseci, a tokom trajanja ovog perioda, dakle pre isteka probnog rada, zaposleni i poslodavac mogu otkazati ugovor o radu sa otkaznim rokom koji ne mo\u017ee biti kra\u0107i od pet radnih dana. U tom slu\u010daju u obavezi si da obrazlo\u017ei\u0161 otkaz ugovora o radu. Pored navedenog, u zavisnosti od industrije kojoj pripada tvoj biznis, postoje odre\u0111ene klauzule koje je izuzetno korisno sadr\u017eati u ugovoru o radu, kao \u0161to je recimo klauzula zabrane konkurencije. Ipak, kod ugovaranja ovakvih klauzula veoma je bitno pa\u017eljivo i precizno formulisati iste, kako bi iste imale i primenu u praksi. \u010cesto se de\u0161ava da se odre\u0111ene specifi\u010dne klauzule ne formuli\u0161u na adekvatan na\u010din, usled \u010dega ne pru\u017eaju za\u0161titu zbog koje su inicijalno i bile inkorporirane u ugovor o radu. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">U ugovoru o radu je bitno i precizno i detaljno navesti u \u010demu se sastoje i \u0161ta sve obuhvataju radne obaveze zaposlenog. Najbolji na\u010din za to jeste da se taksativno navedu radni zadaci koje je zaposleni du\u017ean da obavlja u okviru svog radnog mesta. Na ovaj na\u010din poslodavac mo\u017ee lak\u0161e da prati i radni u\u010dinak i ispunjavanje radnih obaveza zaposlenog, dok \u0107e zaposleni ta\u010dno znati koji su njegovi radni zadaci. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">Pored \u010dinjenice da od izuzetnog zna\u010daja zaklju\u010diti sadr\u017eajan, precizan i jasan ugovor o radu, mnogi radno-pravni aspekti se defini\u0161u u Pravilnikom o radu. Pravilnik o radu je op\u0161ti akt poslodavca koji na sveobuhvatan na\u010din reguli\u0161e odre\u0111ena prava i obaveze koje se primenjuju na sve zaposlene.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Na kraju, va\u017eno je da ima\u0161 u vidu i da Zakon o radu izri\u010dito propisuje zabranu diskriminacije, kako lica koja tra\u017ee zaposlenje tako i zaposlenih. U tom smislu, prilikom izbora kandidata vodi ra\u010duna da je strogo zabranjena diskriminacija u odnosu na uslove za zapo\u0161ljavanje i izbor kandidata kao i uslova za zapo\u0161ljavanje. Svakako, u praksi postoje mnogi programi i alati pomo\u0107u kojih poslodavac mo\u017ee da prati u\u010dinak zaposlenih kao i da na taj na\u010din ocenjuje da li zaposleni ima potrebna znanja i sposobnosti za obavljanje poslova na kojima radi. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">U slu\u010daju da zaposleni ne ostvaruje rezultate rada ili da nema potrebna znanja i sposobnosti za obavljanje poslova na kojima radi, Zakon o radu daje mogu\u0107nost poslodavcu da otka\u017ee ugovor o radu. Me\u0111utim, ovaj otkazni razlog sa sobom povla\u010di posebnu otkaznu proceduru. Predmetna otkazna procedura se ogleda u obavezi poslodavca da zaposlenom da pisano obave\u0161tenje u vezi sa nedostacima u njegovom radu, uputstvima i primerenim rokom za pobolj\u0161anje rada. Zakon o radu ne propisuje koji je to primereni rok za pobolj\u0161anje rada, ve\u0107 ostavlja poslodavcu na ocenu. Prilikom odre\u0111ivanja primerenog roka va\u017eno je uzeti u obzir du\u017einu trajanja radnog odnosa i odrediti adekvatan rok koji \u0107e se ostaviti zaposlenom za pobolj\u0161anje rezultata rada. Tek ukoliko zaposleni ni u ostavljenom roku ne pobolj\u0161a rezultate rada, poslodavac mo\u017ee otkazati ugovor o radu. Kako bi bio siguran da je ispo\u0161tovana zakonska procedura u celosti i da su preduzeti svi neophodni koraci, obavezno se konsultuj sa svojim pravnim savetnikom.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Sa druge strane, ukoliko usled tehnolo\u0161kih, ekonomskih ili organizacionih promena do\u0111e do prestanka potrebe za radom nekog ili nekih zaposlenih, Zakon o radu prepoznaje i mogu\u0107nost raskida radnog odnosa usled pomenutih faktora. I u ovom slu\u010daju nu\u017eno je da ispo\u0161tuje\u0161 zakonsku proceduru i preduzme\u0161 blagovremeno sve neophodne korake kako bi bio siguran da je procedura otkaza sprovedena na zakonit na\u010din. U suprotnom, velika je verovatno\u0107a da \u0107e (biv\u0161i) zaposleni pokrenuti spor pred nadle\u017enim sudom za poni\u0161taj re\u0161enja o otkazu. U tom smislu, ukoliko se nalazi\u0161 u ulozi zaposlenog koji \u017eeli da svoja prava za\u0161titi pred sudom, ima\u0161 mogu\u0107nost da pokrene\u0161 spor u roku od 60 dana od dana dostavljanja spornog re\u0161enja kojim se odlu\u010duje o tvojim pravima i obavezama. Postupak pred sudom mo\u017ee trajati veoma dugo, a isti mo\u017ee biti iscrpljuju\u0107i kako za poslodavca tako i za zaposlenog. Iako je to primarni mehanizam za\u0161tite prava kojim se zaposleni koriste, postoje i alternativni na\u010dini re\u0161avanja radnih sporova \u2013 medijacija, odnosno posredovanje.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Posredovanje je postupak u kojem strane nastoje da spor re\u0161e putem pregovaranja uz pomo\u0107 jednog ili vi\u0161e posrednika. Putem posredovanja strane posti\u017eu dogovor u pogledu pravnih i \u010dinjeni\u010dnih pitanja, a sam postupak je strogo poverljiv. Navedeno zna\u010di da su svi predlozi izneti od bilo koje strane poverljivi i da se ne mogu koristiti u sudskom, arbitra\u017enom ili drugom postupku, niti se mogu saop\u0161titi tre\u0107im licima na drugi na\u010din. Ono \u0161to je veoma va\u017eno znati jeste da sam postupak posredovanja strane mogu pokrenuti pre ili nakon pokrenutog sudskog postupka. Dakle, ukoliko je zaposleni pokrenuo radni spor pred sudom, navedeno nije prepreka da se ipak pokrene postupak posredovanja i da se spor okon\u010da mirnim putem. Sa druge strane, kako je Zakonom o radu propisan poseban rok za podno\u0161enje tu\u017ebe, treba imati u vidu da taj rok ne te\u010de dok postupak posredovanja traje, ali ne du\u017ee od 60 dana. Dakle, ukoliko je postupak posredovanja pokrenut pre isteka roka za podno\u0161enje tu\u017ebe, navedeni rok ne\u0107e te\u0107i ali ne du\u017ee od 60 dana. Ovim putem je zakonodavac \u017eeleo da uka\u017ee da je postupak posredovanja hitan i da bi strane trebalo da nastoje da u kratkom roku postignu sporazum.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">U slu\u010daju da strane postignu dogovor, sa\u010dinjava se sporazum o re\u0161avanju spora u pisanoj formi. Navedeni sporazum mo\u017ee imati svojstvo izvr\u0161ne isprave na osnovu koje se mo\u017ee pokrenuti izvr\u0161ni postupak, ali samo ukoliko su ispunjeni odre\u0111eni uslovi.
