{"id":7576,"date":"2025-10-30T14:44:49","date_gmt":"2025-10-30T13:44:49","guid":{"rendered":"https:\/\/ncrlawyers.com\/?p=7576"},"modified":"2025-10-30T14:44:53","modified_gmt":"2025-10-30T13:44:53","slug":"ugovor-o-radu-za-it-srbija","status":"publish","type":"post","link":"https:\/\/ncrlawyers.com\/sr\/ugovor-o-radu-za-it-srbija\/","title":{"rendered":"Ugovor o radu za IT sektor u Srbiji &#8211; elektronsko potpisivanje i zabrana konkurencije"},"content":{"rendered":"\n<p>Sve vi\u0161e je primera u praksi koji potvr\u0111uju da kori\u0161\u0107enje \u201e\u0161ablonskih\u201c ugovora o radu ili priprema ugovora o radu od strane lica koje nije stru\u010dno, odnosno nije pravnik ili advokat, donosi mnogo \u0161tete kompanijama koje koriste takav pristup. Zasnivanje radnog odnosa zahteva pa\u017eljivo definisanje svih prava i obaveza i potencijalnih situacija do kojih mo\u017ee do\u0107i u toku radnog odnosa, kroz sveobuhvatan ugovor o radu.<\/p>\n\n\n\n<p>Naro\u010dito je bitno da kompanije u IT sektoru posvete pa\u017enju prilikom zaklju\u010denja ugovora o radu sa zaposlenima, imaju\u0107i u vidu brojne specifi\u010dnosti vezane za ovu industriju.<\/p>\n\n\n\n<p>Ono \u0161to je karakteristi\u010dno za radni odnos u IT sektoru jeste hibridni model rada, odnosno mogu\u0107nost rada od ku\u0107e, kompleksna pitanja u vezi sa intelektualnom svojinom kao i druge klauzule koje \u0107emo spomenuti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0160ta je IT ugovor o radu i za\u0161to je specifi\u010dan?<\/h2>\n\n\n\n<p>IT industrija spada me\u0111u najdinami\u010dnije i najbr\u017ee rastu\u0107e sektore rada u Srbiji i svetu. Brze promene tehnologija, fleksibilni oblici anga\u017eovanja i sve \u010de\u0161\u0107i rad na daljinu \u010dine da klasi\u010dan \u201e\u0161ablonski\u201c ugovor o radu nije adekvatan za regulisanje svih aspekata radnog odnosa.<\/p>\n\n\n\n<p>Za IT stru\u010dnjake, ugovor mora biti prilago\u0111en specifi\u010dnostima profesije \u2013 uklju\u010duju\u0107i odredbe o intelektualnoj svojini, za\u0161titi poslovnih tajni, hibridnom modelu rada odnosno radu od ku\u0107e kao i klauzuli zabrane konkurencije.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Zakonski osnov i obavezni elementi ugovora o radu u IT-u<\/h2>\n\n\n\n<p>Zakon o radu propisuje \u0161ta su to <strong><a href=\"https:\/\/ncrlawyers.com\/sr\/ugovor-o-radu-srbija\/\">obavezni elementi ugovora o radu<\/a><\/strong> koje isti mora da sadr\u017ei. U tom smislu, zakonom je propisan zakonski minimum koji nije mogu\u0107e izmeniti ugovorom o radu niti ih izostaviti. Radi poja\u0161njenja, u pitanju su odredbe koje se odnose, izme\u0111u ostalog, na slede\u0107e elemente:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Da li se radni odnos zasniva na odre\u0111eno ili neodre\u0111eno \u2013 ukoliko se radni odnos zasniva na odre\u0111eno, za to mora da postoji pravni osnov;<\/li>\n\n\n\n<li>Naziv i opis poslova koje zaposleni obavlja;<\/li>\n\n\n\n<li>Radno vreme;<\/li>\n\n\n\n<li>Trajanje dnevnog i nedeljnog radnog vremena.<\/li>\n<\/ul>\n\n\n\n<p>U tom smislu, zakon propisuje i minimalno trajanje odmora u toku dnevnog rada, kao i dnevni, nedeljni i godi\u0161nji odmor. Primera radi, zaposleni ima pravo na godi\u0161nji odmor u svakoj kalendarskoj godini u trajanju od najmanje 20 dana.<\/p>\n\n\n\n<p>Dakle, ukoliko bi ugovorom o radu bio propisan manji broj dana godi\u0161njeg odmora, takva odredba bi bila ni\u0161tava i primenila bi se odredba Zakona o radu.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Specifi\u010dnosti ugovora o radu u IT sektoru<\/h2>\n\n\n\n<p>Kada je u pitanju zaklju\u010divanje ugovora o radu u IT sektoru, postoje odre\u0111ene specifi\u010dnosti koje su vezane za takvu vrstu radnog odnosa, a one naj\u010de\u0161\u0107e obuhvataju:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Rad od ku\u0107e \/ hibridni model rada;<\/li>\n\n\n\n<li>Klauzula vezano za za\u0161titu intelektualne svojina;<\/li>\n\n\n\n<li>Klauzula o za\u0161titi poslovne tajne \u2013 NDA;<\/li>\n\n\n\n<li>Klauzula zabrane konkurencije;<\/li>\n\n\n\n<li>Klauzula zabrane vrbovanja;<\/li>\n\n\n\n<li>Benefiti \u2013 obuke, kursevi, konferencije.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Klauzula za\u0161tite intelektualne svojine<\/h3>\n\n\n\n<p>Izuzetno bitna klauzula koju je nu\u017eno uvrstiti u ugovor o radu u IT sektoru jeste klauzula za\u0161tite intelektualne svojine. Po pravilu, u ovoj sferi poslovanja zaposleni obavljaju kompleksne radne zadatke, te je va\u017eno ugovorom o radu definisati ko je nosilac prava u vezi sa delima intelektualne svojine nastalim tokom trajanja radnog odnosa.<\/p>\n\n\n\n<p>U tom smislu, <strong><a href=\"https:\/\/ncrlawyers.com\/sr\/registracija-patenta-srbija\/\">prava intelektualne svojine<\/a><\/strong> mogu da obuhvataju, izme\u0111u ostalog, softverske i kompjuterske kodove, baze podataka, planove, skice i druga dokumenta. Nekada je ova klauzula deo ugovora o radu, a u odre\u0111enim slu\u010dajevima se zaklju\u010duje i poseban <strong><a href=\"https:\/\/ncrlawyers.com\/sr\/ugovor-o-poverljivosti-podataka-nda-srbija\/\">ugovor o poverljivosti \u2013 NDA<\/a><\/strong>, koji na detaljniji na\u010din reguli\u0161e ovu obavezu.<\/p>\n\n\n\n<p>Uzimaju\u0107i u obzir specifi\u010dnosti IT sektora, neminovno je da tokom trajanja radnog odnosa zaposleni do\u0111e u posed poverljivih informacija, koje se odnose na poslovanje poslodavca. \u0160ta se smatra poverljivim informacijama je potrebno definisati u samom ugovoru, a one obi\u010dno obuhvataju podatke o poslovanju, marketing strategijama, poslovnim analizama i planovima i sli\u010dno.<\/p>\n\n\n\n<p>Pored definisanja \u0161ta obuhvata pojam poverljivih informacija, neophodno je utvrditi i mehanizam za\u0161tite poslodavca u slu\u010daju da do\u0111e do kr\u0161enja ove obaveze na strani zaposlenog. Iz tog razloga je bitno posebnu pa\u017enju posvetiti ovoj odredbi ugovora o radu i preduprediti mogu\u0107e ne\u017eeljene scenarije.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Klauzula zabrane konkurencije u IT sektoru<\/h2>\n\n\n\n<p>Jedna od naj\u010de\u0161\u0107ih klauzula koja se ugovara prilikom zaklju\u010denja ugovora o radu jeste klauzula zabrane konkurencije. Iako ova klauzula nije usko vezana za IT sektor, u praksi se \u010desto de\u0161ava da ova odredba nije adekvatno sro\u010dena, \u0161to za posledicu ima da se ni njena svrha ne mo\u017ee ostvariti.<\/p>\n\n\n\n<p>Klauzula zabrane konkurencije se ugovara u situacijama kada zaposleni radom kod poslodavca mo\u017ee da stekne nova, va\u017ena tehnolo\u0161ka znanja, \u0161irok krug poslovnih partnera ili da do\u0111e do saznanja va\u017enih poslovnih informacija i tajni. U tom slu\u010daju, cilj ove klauzule jeste za\u0161tita poslodavca i njegovog poslovanja od mogu\u0107ih postupaka zaposlenih. Ovom klauzulom se utvr\u0111uju poslovi koje zaposleni ne mo\u017ee da radi u svoje ime i za svoj ra\u010dun ili pak u ime i za ra\u010dun drugog fizi\u010dkog ili pravnog lica, bez saglasnosti poslodavca.<\/p>\n\n\n\n<p>Dakle, cilj je da poslodavac za\u0161titi svoje poslovanje u odnosu na mogu\u0107nost da zaposleni zasnuje radni odnos kod drugog poslodavca koriste\u0107i se informacijama i znanjem do kojeg je do\u0161ao tokom trajanja radnog odnosa.<\/p>\n\n\n\n<p>Klauzula zabrane konkurencije se ugovara za vreme trajanja radnog odnosa, ali se njeno va\u017eenje mo\u017ee produ\u017eiti i nakon prestanka radnog odnosa. Upravo u ovim situacijama, kada poslodavac \u017eeli da produ\u017ei va\u017eenje ove klauzule i nakon prestanka radnog odnosa, u praksi dolazi do \u010destih problema, usled \u010dinjenice da je tekst same klauzule neva\u017ee\u0107i. Do ovakvih situacija mo\u017ee do\u0107i kada ugovor o radu ne priprema <strong><a href=\"https:\/\/ncrlawyers.com\/sr\/\">advokat za radno pravo<\/a><\/strong>, ve\u0107 odre\u0111ena lica koja ne poseduju stru\u010dna znanja.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-large\"><img data-recalc-dims=\"1\" decoding=\"async\" width=\"1024\" height=\"692\" src=\"https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/10\/klauzula-zabrane-konkurencije-it.jpg?resize=1024%2C692&#038;ssl=1\" alt=\"Klauzula zabrane konkurencije u IT ugovoru o radu\" class=\"wp-image-7582\" srcset=\"https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/10\/klauzula-zabrane-konkurencije-it.jpg?resize=1024%2C692&amp;ssl=1 1024w, https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/10\/klauzula-zabrane-konkurencije-it.jpg?resize=300%2C203&amp;ssl=1 300w, https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/10\/klauzula-zabrane-konkurencije-it.jpg?resize=768%2C519&amp;ssl=1 768w, https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/10\/klauzula-zabrane-konkurencije-it.jpg?w=1500&amp;ssl=1 1500w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n\n\n<p>Ono \u0161to je va\u017eno imati u vidu prilikom ugovaranja da klauzula zabrane konkurencije va\u017ei i nakon prestanka radnog odnosa jeste da u tom slu\u010daju poslodavac se mora obavezati da zaposlenom, za period va\u017eenja klauzule, ispla\u0107uje naknadu. Dodatno, maksimalan rok va\u017eenja klauzule zabrane konkurencije nakon prestanka radnog odnosa je dve godine i isti se ne mo\u017ee produ\u017eiti.<\/p>\n\n\n\n<p>Zna\u010daj klauzule zabrane konkurencije kao i za\u0161tita koju ova klauzula obezbe\u0111uje poslodavcu jesu veliki, ali samo u slu\u010daju da je ista pripremljena na odgovaraju\u0107i na\u010din.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Elektronsko potpisivanje IT ugovora o radu \u2013 pravna validnost<\/h2>\n\n\n\n<p>Iako je sfera digitalizacije u jeku, te je vrlo \u010desto brzina i efikasnost u procesu zasnivanja radnog odnosa klju\u010dna, u praksi se \u010desto postavlja pitanje da li se ugovor o radu mo\u017ee potpisati elektronskim putem.<\/p>\n\n\n\n<p>Iako se <strong><a href=\"https:\/\/ncrlawyers.com\/sr\/kvalifikovani-elektronski-potpis-srbija\/\">elektronski potpis u Srbiji<\/a><\/strong> koristi svakodnevno u poslovanju, \u0161to zna\u010dajno doprinosi efikasnosti i brzini procesa, ugovor o radu nije mogu\u0107e potpisati na ovaj na\u010din. Razlog za to je \u0161to Zakon o radu eksplicitno predvi\u0111a da se ugovor o radu mora potpisati od strane zaposlenog i poslodavca, te da se isti zaklju\u010duje u najmanje tri primerka.
