{"id":7680,"date":"2025-11-13T11:48:48","date_gmt":"2025-11-13T10:48:48","guid":{"rendered":"https:\/\/ncrlawyers.com\/?p=7680"},"modified":"2025-11-13T11:49:58","modified_gmt":"2025-11-13T10:49:58","slug":"upis-prava-svojine-u-katastar-srbija","status":"publish","type":"post","link":"https:\/\/ncrlawyers.com\/sr\/upis-prava-svojine-u-katastar-srbija\/","title":{"rendered":"Upis prava svojine u katastar u Srbiji \u2013 Vodi\u010d kroz postupak uknji\u017ebe nekretnine korak po korak"},"content":{"rendered":"\n<p>Shodno zakonskoj regulativi u Srbiji, zaklju\u010denje ugovora o kupoprodaji nepokretnosti ili ugovora o poklonu nepokretnosti ne vodi automatski sticanju prava svojine na tim nepokretnostima.<\/p>\n\n\n\n<p>Naime, priprema i zaklju\u010denje ugovora predstavlja prvi korak ka sticanju prava svojine, dok se odre\u0111eno lice smatra imaocem prava svojine tek upisom prava svojine u katastar nepokretnosti.<\/p>\n\n\n\n<p>Dakle, neophodno je da se izvr\u0161i upis prava svojine u katastar nepokretnosti kako biste postali vlasnik nepokretnosti.<\/p>\n\n\n\n<p>Dodatno, u praksi su veoma \u010deste situacije u kojima lice \u017eeli da proda nepokretnost, me\u0111utim kao imalac prava svojine nije upisano to lice ve\u0107 neki od prethodnih vlasnika. U tom slu\u010daju je potrebno prethodno izvr\u0161iti upis vlasni\u0161tva u katastar, kako bi se nepokretnost mogla dalje prometovati.<\/p>\n\n\n\n<p>U ovom tekstu \u0107emo pojasniti \u010ditav proces \u2013 od pripreme dokumentacije i podno\u0161enja zahteva do izdavanja re\u0161enja nadle\u017ene slu\u017ebe za katastar nepokretnosti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0160ta zna\u010di upis prava svojine u katastar?<\/h2>\n\n\n\n<p>Upis prava svojine u katastar nepokretnosti je zapravo na\u010din na koji odre\u0111eno lice sti\u010de pravo svojine na nepokretnostima u Srbiji.<\/p>\n\n\n\n<p>Dakle, da biste stekli pravo svojine neophodno je da postoji pravni osnov (ugovor o kupoprodaji nepokretnosti, ugovor o poklonu nepokretnosti, re\u0161enje o nasle\u0111ivanju), a zatim i da na osnovu konkretne isprave koja \u010dini pravni osnov sticanja, izvr\u0161ite upis prava svojine u katastar nepokretnosti.<\/p>\n\n\n\n<p>Upisom prava svojine na nepokretnosti dokazuje se vlasni\u0161tvo na predmetnoj nepokretnosti, te je stoga va\u017eno da se i ovaj korak sprovede.<\/p>\n\n\n\n<p>Posebno su izazovne situacije kada je vr\u0161eno prometovanje nepokretnosti, a nije vr\u0161en upis svojine. U tom slu\u010daju je procedura upisa prava svojine dugotrajnija i podrazumeva ve\u0107i broj dokumenata koji je potrebno prikupiti i podneti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ko je du\u017ean da izvr\u0161i upis prava svojine u Srbiji?<\/h2>\n\n\n\n<p>Upis vlasni\u0161tva u katastar nepokretnosti potrebno je izvr\u0161iti u svim situacijama kada se prometuje nepokretnost, odnosno kada se vr\u0161i kupovina nepokretnosti, poklon nepokretnosti ili u slu\u010daju nasle\u0111ivanja nepokretnosti.<\/p>\n\n\n\n<p>Upis prava svojine se ne vr\u0161i automatski, ve\u0107 je neophodno pokrenuti postupak za upis. Sam postupak upisa je definisan <a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon-o-postupku-upisa-u-katastar-nepokretnosti-i-vodova.html\">Zakonom o postupku upisa u katastar nepokretnosti i vodova<\/a>.<\/p>\n\n\n\n<p>Postoje dva mogu\u0107a na\u010dina na koja se pokre\u0107e postupak:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>po slu\u017ebenoj du\u017enosti,<\/li>\n\n\n\n<li>na zahtev stranke.<\/li>\n<\/ul>\n\n\n\n<p>Postupak po slu\u017ebenoj du\u017enosti se pokre\u0107e kada nadle\u017enoj slu\u017ebi za katastar nepokretnosti odre\u0111eni organi dostave isprave za upis \u2013 a to su javni bele\u017enici, sudovi, javni izvr\u0161itelji ili organi javne uprave.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-large\"><img data-recalc-dims=\"1\" fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"699\" src=\"https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/11\/katastar-nepokretnosti-rgz-beograd.jpg?resize=1024%2C699&#038;ssl=1\" alt=\"Katastar nepokretnosti RGZ Beograd \u2013 slu\u017eba za uknji\u017ebu\" class=\"wp-image-7686\" srcset=\"https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/11\/katastar-nepokretnosti-rgz-beograd.jpg?resize=1024%2C699&amp;ssl=1 1024w, https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/11\/katastar-nepokretnosti-rgz-beograd.jpg?resize=300%2C205&amp;ssl=1 300w, https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/11\/katastar-nepokretnosti-rgz-beograd.jpg?resize=768%2C524&amp;ssl=1 768w, https:\/\/i0.wp.com\/ncrlawyers.com\/wp-content\/uploads\/2025\/11\/katastar-nepokretnosti-rgz-beograd.jpg?w=1500&amp;ssl=1 1500w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n\n\n<p>Navedeno zna\u010di da, ukoliko zaklju\u010dite ugovor o kupoprodaji nepokretnosti pred javnim bele\u017enikom, javni bele\u017enik \u0107e poslati nadle\u017enoj slu\u017ebi za katastar nepokretnosti predmetni ugovor koji je osnov sticanja, kao i drugu dokumentaciju, i na taj na\u010din pokrenuti postupak za upis prava svojine. U kratkom roku nakon toga \u0107e katastar sprovesti upis prava svojine, te \u0107e taj upis biti evidentiran u javnu bazu katastra nepokretnosti.<\/p>\n\n\n\n<p>Navedeno je bitno i u situaciji kada stranci kupuju nepokretnosti u Srbiji, jer umnogome olak\u0161ava \u010ditav proces kupovine.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Postupak upisa prava svojine u Srbiji po zahtevu stranke \u2013 korak po korak<\/h2>\n\n\n\n<p>Ukoliko ste u situaciji da u katastru nepokretnosti niste nikada upisali svoje pravo svojine na nepokretnosti, odnosno da ste tzv. \u201evanknji\u017eni vlasnik\u201c, onda je potrebno da \u0161to pre podnesete zahtev za upis prava svojine. Priprema potrebne dokumentacije<\/h3>\n\n\n\n<p>Prvi korak svakako jeste priprema potrebne dokumentacije koju je potrebno podneti uz zahtev. Situacija je komplikovanija ukoliko se vi\u0161e lica nije pravovremeno upisalo u katastar, pa je potrebno u tom slu\u010daju dostaviti dokumentaciju kojom se dokazuje pravni sled.<\/p>\n\n\n\n<p>Dakle, ukoliko ste tre\u0107i kupac nepokretnosti po redu, a u katastru je upisan prvi vlasnik, potrebno je dostaviti svu dokumentaciju koja \u0107e dokazati pravni sled do vas kao poslednjeg vlasnika.<\/p>\n\n\n\n<p>\u010cesta je situacija i sa situacijama kada su se zaklju\u010divali ugovori o kupovini stanova u dru\u0161tvenoj svojini. U tom slu\u010daju je neophodno veoma \u010desto pribavljati potvrde da je ispla\u0107ena kupoprodajna cena kao i saglasnost kojom se dozvoljava uknji\u017eba prava svojine.<\/p>\n\n\n\n<p>Dakle, u zavisnosti od konkretnog slu\u010daja, dokumentacija koju je potrebno pripremiti i dostaviti uz zahtev obuhvata:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ugovor o kupoprodaji, poklonu ili drugi ugovor o prometovanju nepokretnosti<\/li>\n\n\n\n<li>dokaz o pla\u0107enoj kupoprodajnoj ceni ili drugu potvrdu (saglasnost za upis prava svojine)<\/li>\n\n\n\n<li>kopiju li\u010dne karte<\/li>\n\n\n\n<li>punomo\u0107je.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">2. Podno\u0161enje zahteva RGZ-u<\/h3>\n\n\n\n<p>Nakon \u0161to je prikupljena sva potrebna dokumentacija, zahtev se podnosi putem portala <a href=\"https:\/\/www.rgz.gov.rs\/e-%C5%A1alter\">e\u0160alter<\/a> aplikacije.<\/p>\n\n\n\n<p>Zahtev za upis prava svojine putem aplikacije e\u0160alter mo\u017ee podneti profesionalni korisnik, odnosno lice koje ima odobren pristup ovoj aplikaciji. Obrada i dono\u0161enje re\u0161enja<\/h3>\n\n\n\n<p>Nakon podnetog zahteva Republi\u010dki geodetski zavod donosi re\u0161enje kojim se sprovodi promena odnosno dozvoljava upis prava svojine i takva promena se evidentira u bazi katastra nepokretnosti.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Izdavanje lista nepokretnosti<\/h3>\n\n\n\n<p>Nakon \u0161to je izvr\u0161ena promena vlasni\u0161tva u katastru, nov vlasnik mo\u017ee pribaviti list nepokretnosti, odnosno izvod iz baze katastra nepokretnosti putem kog se evidentira ko je novi vlasnik. Ovaj dokument ujedno sadr\u017ei i ostale va\u017ene informacije o nepokretnosti, kao \u0161to su broj katastarske parcele, katastarsku op\u0161tinu, adresu na kojoj se nalazi nepokretnost i sli\u010dno.<\/p>\n\n\n\n<p>Pristup podacima o nepokretnostima koje su upisane u katastar nepokretnosti se mo\u017ee dobiti putem <a href=\"https:\/\/www.rgz.gov.rs\/e-katastar\">eKatastra<\/a>.
