New recommendation of the Government regarding the use of annual leave in Serbia

On 11th February 2021, the Government of the Republic of Serbia issued a Conclusion recommending to all employers in the territory of the Republic of Serbia to enable employees to start and use the corresponding vacation for 2020 in 2021, no later than 30 June 2022, as well as to enable them to use part of the annual leave from 2019 by June 30, 2021 at the latest, and before using the corresponding annual leave for 2020.

In this way, the Conclusion extends the deadlines prescribed by the Labor Law for the use of annual leave for employees who due to objective circumstances caused by the epidemic of infectious disease Covid 19 were not able to use the corresponding annual leave for 2020 and part of annual leave for 2019.

The Ministry of Labor, Employment, Veterans’ Affairs and Social Affairs states that the Conclusion refers to employees who, due to the nature of work in extraordinary circumstances due to the epidemic of infectious disease Covid 19, due to temporary incapacity for work due to infectious disease Covid 19 or due to isolation / home isolations in accordance with the law did not use the corresponding annual leave for 2020 and / or part of the annual leave from 2019 until the end of 2020.

Given that the Conclusion in question applies to all employers in the territory of the Republic of Serbia, it repealed the Conclusion of the Government of the Republic of Serbia of 15 December 2020, which referred only to the extension of annual leave for certain categories of employees in institutions in the field of social and health care and the Ministry of Health.
